Listing Agreement

Draft for review by counsel before it is relied on. Version 1.0, effective 6 September 2026. This is the agreement a guide or outfitter accepts when claiming a profile on GuidedFloats. If you have not claimed a profile, nothing here applies to you — see the Public Profile Policy instead.

1. Who you are agreeing with

GuidedFloats.com is operated by Guided Floats, LLC, a Missouri limited liability company. In this agreement “GuidedFloats”, “we” and “us” mean Guided Floats, LLC, and “you” means the guide, guide service or outfitting business whose profile is being claimed. This agreement sits on top of our Terms of Service and Privacy Policy. Where this agreement and the Terms of Service disagree about listings, leads or commission, this agreement governs.

2. What claiming a profile means

Claiming is free. Before we hand a profile over we verify you, either through the business’s own website domain or by calling the business number the business itself publishes. Once verified you control the profile: descriptions, photos, waters, trip types, rates and availability.

You confirm that you own the business named on the profile, or that you are authorised by it to act for it. The agreement binds the business, not you personally. If you claim a business you have no authority over, we will unclaim the profile and may refuse future claims.

A claimed profile stays a public page. Claiming does not transfer the page to you and does not give you rights over the waterway pages, the directory, or any other part of the site.

3. Version, acceptance and changes

You accept a numbered version of this agreement at the moment you claim. We record which version you accepted, the name and email address you gave, and the date and time. You can ask us for a copy of that record at any time.

We will publish changes here with a new version number. For a change that materially affects your money, your data or your obligations we will give you at least 30 days’ notice by email before it takes effect. If you do not want the new version, you may leave under section 12 before it starts — there is no penalty for leaving.

4. Accuracy of your business information

You are responsible for everything on your profile once you claim it. You agree that:

  • The business name, town, phone number, website, waters, species, trip types and starting price on your profile are accurate, and you will correct them within 14 days of anything changing.
  • You will not list a water you do not actually guide, or advertise a trip you cannot legally run.
  • Photos and text you upload are yours, or you have permission to use them, and they show your own operation.
  • You will not claim credentials, awards, certifications or affiliations you do not hold.

We may correct an obvious factual error, and we may unpublish a profile that is materially inaccurate until it is fixed. We will tell you why.

5. Licences, permits and insurance

You represent, on the day you claim and on every day the profile stays claimed, that:

  • You hold every licence, permit, registration and authorisation required to guide where you say you guide — state guide or outfitter licensing, any federal special-use authorisation on Forest Service, Park Service, BLM or Corps of Engineers water, and any local permit that applies.
  • Where your trips are run under Coast Guard jurisdiction, the operator and the vessel meet the applicable requirements.
  • You carry liability insurance appropriate to the trips you sell.
  • You will send us evidence of any of the above within 10 days of our asking.
  • You will tell us within 5 days if any of it lapses, is suspended or is revoked. We will suspend the profile until it is back in force.

We do not verify any of this. A profile on GuidedFloats is not a certification, an endorsement, or evidence that anyone has checked your paperwork, and we do not present it as one.

6. Running the trip

The trip is yours. You decide whether to accept a booking, you set your rates, you run the day, and you are responsible for safety, for your boat and equipment, for your guides and staff, and for compliance with fishing regulations and access rules. GuidedFloats never restates fishing regulations — we link to the agency that writes them, and the current rule is whatever that agency says it is.

River and lake conditions shown on this site come from public USGS and US Army Corps of Engineers feeds. Those readings are provisional, sometimes late and sometimes wrong. Do not make a safety decision for a trip on the strength of a number on this website.

7. Leads and angler information

When an angler asks about your availability through GuidedFloats we pass you what they gave us: their name, email, phone, the dates and party size, the water, and their note. That information reaches you because the angler asked to reach you. You agree that:

  • You will use it only to respond to that enquiry and to arrange and run the trip.
  • You will respond or decline within 48 hours. If you are going to be unavailable, tell us and we will pause your listing rather than leave anglers waiting.
  • You will not sell it, rent it, or trade it, and you will not add the angler to a marketing list, newsletter or SMS campaign without their consent.
  • You will not share it outside your own business except with the staff running that trip.
  • You will stop using it and delete it if the angler asks you to, or if we tell you the angler has asked us.
  • You will tell us within 72 hours if information we passed you is exposed, lost or misused.

Once we hand a lead to you, you are responsible for it under the privacy laws that apply to your business. We are responsible for our own handling of it, which is described in the Privacy Policy.

8. Bookings, money and commission

As of the effective date above, no money moves through GuidedFloats. Bookings are requests: we introduce the angler, and you and the angler settle directly. Until platform payments launch, no commission is payable and no invoice will be sent.

When platform payments do launch, the commission published on /for-guides/ for your plan applies to bookings taken through the platform. Rates and plan prices live on that page and nowhere else, so there is only ever one number to check. Then:

  • Commission is calculated on the trip price only — not on sales tax, tips, licences you buy on the angler’s behalf, or third-party lodging.
  • No commission is due on a trip that is cancelled and not charged, on trips you book outside GuidedFloats, or on a returning client who books with you directly.
  • We will give you at least 60 days’ notice before your first invoice, and we will not invoice at all until the dashboard can show you the views and leads your profile actually produced.
  • We will give at least 30 days’ notice of any change to commission rates or subscription prices. A price change never applies to a period you have already paid for.

9. Where your profile appears

Placement on water pages follows the order published in our Terms of Service: premium and outfitter profiles first, then claimed free profiles, then unclaimed profiles. Inside each group the order is reviews, response time and calendar accuracy.

There is no bidding and no auction. Paying moves you above free profiles; it never moves you above another paying profile, and it never buys a review or a rating. A subscription buys distribution and speed — it is not a promise of any number of leads, bookings or dollars, and we do not make one.

10. Reviews

When reviews launch, they come from anglers who booked through the platform. You will be able to reply to any review of your business. We remove reviews that are abusive, off-topic, or written by someone with an undisclosed interest. We do not remove a review simply because it is negative, and we do not sell review removal.

11. Suspension and termination by us

We may suspend or end a claimed listing if a representation in sections 4 or 5 turns out to be untrue, if a required licence or insurance lapses, if leads are misused under section 7, if you charge an angler for a trip you do not run, or if invoices go unpaid once billing begins. Except where the risk to anglers is immediate, we will tell you what the problem is and give you a fair chance to fix it first.

12. How to leave

You can leave at any time, for any reason, without talking to anyone. Email hello@guidedfloats.com, or use the removal panel on your own profile page. You choose one of two things:

  • Unclaim. You give up control of the page and any paid plan stops at the end of the current billing period. The page stays up as an unclaimed listing rebuilt from public sources, exactly as described in the Public Profile Policy. Photos and descriptions you uploaded are deleted.
  • Remove. The page comes down. Within minutes it is set to noindex and drops out of the directory listings; within 72 hours the page itself is taken down, along with the paired guide or outfitter record for the same business. We do not put it back unless you ask.

There is no exit fee and no notice period. Cancelling stops the next renewal: a monthly plan runs to the end of the period you have paid for, an annual plan to the end of the year you have paid for, and fees already paid are not refunded. You do not have to wait for either to end before leaving — unclaim or removal takes effect straight away. We keep a record that you asked and when, so that we can show the request was honoured.

13. What we are and are not responsible for

GuidedFloats is a directory and an introduction service. The trip contract is between you and the angler: we are not a party to it, we are not your agent, and we do not employ, supervise, train or schedule you or your guides. Nothing here creates a partnership, a franchise or an exclusive arrangement. This listing is non-exclusive, you are free to list anywhere else, and you may book your own clients directly and owe us nothing on those bookings.

We provide the site as it is. We do not warrant that flow, temperature or pool data is accurate or current, that the site will be uninterrupted, or that a listing will produce business. To the extent the law allows, neither of us is liable to the other for lost profits or indirect losses, and our total liability to you for any claim is limited to the greater of the fees you paid us in the 12 months before the claim or one hundred dollars.

You will cover us against claims brought by an angler or a third party that arise from a trip you ran, from content you supplied, or from a representation in section 5 turning out to be untrue.

14. Law, notices and the whole agreement

Missouri law governs this agreement, and the state and federal courts in Missouri are where disputes are heard. Notices to you go to the email address on your claim record; notices to us go to the addresses in section 1. If a clause is unenforceable the rest survives. This agreement, the Terms of Service, the Privacy Policy, the Public Profile Policy and the published plan terms on /for-guides/ are the whole of what we have agreed.
